Anniversary Grand Prize: Terms & Conditions

1. Organiser

The anniversary promotion is organised by Resurge Lifestyle Private Limited, the owner and operator of AETERNUM (“AETERNUM”, “the Company”, “we”, “us” or “our”).

The grand prize stay is being offered in collaboration with The Fleeting Clouds, subject to the terms set out below.

2. Promotional Period

The promotion will run from 1 November 2026 to 30 November 2026, both dates inclusive (“Promotional Period”).

Only qualifying orders placed and successfully paid for during this period will be considered for entry.

3. Eligibility

• Participation is open to individuals aged 18 years or above who are residents of India.
• The qualifying purchase must be made through the official AETERNUM website, www.aeternumindia.com.
• Employees, directors, representatives and immediate family members of Resurge Lifestyle Private Limited and The Fleeting Clouds, and any persons directly involved in administering the promotion, are not eligible.
• AETERNUM reserves the right to request reasonable proof of identity, age, residence and order details to verify eligibility.

4. Qualifying Purchase and Entry

• A customer must place an order with a final payable value of at least ₹6,000 after applying the 30% anniversary discount to qualify.
• The qualifying value is the final order amount payable by the customer, inclusive of applicable GST and shipping charges.
• Each qualifying order will earn one entry into the grand prize draw.
• Multiple qualifying orders placed by the same customer during the Promotional Period will earn multiple entries, provided each order independently meets the qualifying purchase requirement.
• Orders cannot be combined to meet the minimum qualifying value.
• An order that does not meet the minimum qualifying value will not qualify, irrespective of the customer's total spending across other orders.
• Entries are generated against qualifying orders. No separate registration is required.

5. Order Validity and Disqualification

• Only successfully paid orders will be considered.
• Cancelled orders, failed payments, fraudulent transactions, and orders that are fully refunded will not qualify.
• If a return, partial refund, price adjustment or other reversal reduces the retained order value below ₹6,000, the corresponding entry will become invalid.
• If an order is disputed or charged back, AETERNUM reserves the right to withhold or invalidate the associated entry pending verification.
• AETERNUM may disqualify entries arising from suspected misuse, manipulation, fraudulent activity or violation of these Terms & Conditions.
• Any disqualification will be based on reasonable grounds and may be communicated to the affected participant.

6. Grand Prize Details

One eligible participant will be selected to receive:

• A two-night stay for two persons at a participating property in Kufri, Himachal Pradesh.
• Breakfast for both guests during the stay.

The prize is provided in collaboration with The Fleeting Clouds.

The grand prize covers room accommodation (room rent only with breakfast included) for two persons for two consecutive nights at the participating property in Kufri, Himachal Pradesh.

Unless expressly confirmed in writing as part of the prize, the following are excluded and shall be payable directly by the winner:

• Food and beverages, including meals other than breakfast, unless specifically confirmed as included.
• Local tours, sightseeing, excursions and recreational activities.
• Additional beds, extra guests, room upgrades or additional nights.
• Transportation, local transfers and travel expenses.
• Room service, laundry, personal expenses and incidental charges.
• Any other services, facilities or add-ons not expressly specified as included in the prize.

Any additional services requested by the winner will be subject to the property's availability, approval and applicable charges. The winner shall be solely responsible for settling such additional charges directly with the property or service provider.

7. Winner Selection and Announcement

• One winner will be selected through a random draw from all valid entries received during the Promotional Period.
• Each qualifying order will be treated as a separate entry, irrespective of the number of entries held by an individual customer.
• The draw will take place after the Promotional Period closes on 30 November 2026.
• AETERNUM will contact the selected winner using the contact details associated with the qualifying order.
• The winner may be required to provide reasonable documentation to verify identity, age, residence and eligibility.
• The selection will be subject to verification of the qualifying order and compliance with these Terms & Conditions.
• AETERNUM's records of qualifying orders and entries will be used to administer the draw.

8. Winner Response and Verification

• The selected winner must respond to AETERNUM's official communication within 48 hours of being notified.
• The winner must provide the requested verification details within the timeframe communicated by AETERNUM.
• If the selected winner does not respond within the stipulated period, fails to provide the required information, is found ineligible, or declines the prize, AETERNUM reserves the right to disqualify that selection and conduct a fresh random draw from the remaining valid entries.
• The prize will be confirmed only after successful verification and acceptance by the selected winner.

9. Prize Redemption and Availability

• The prize must be redeemed and the stay completed no later than 31 March 2027.
• The stay is strictly subject to the participating property's availability, operating schedule, applicable restrictions and confirmation by The Fleeting Clouds.
• The winner must coordinate the preferred stay dates with AETERNUM and/or The Fleeting Clouds in advance.
• The winner may be required to provide at least three preferred date options within the redemption period. These dates will be considered subject to availability and are not guaranteed until a written booking confirmation is issued.
• Blackout Dates and Restricted Periods: The complimentary stay cannot be availed during peak travel seasons, long weekends, national holidays, public holidays, festive periods or other high-demand dates, including but not limited to Diwali, Christmas and New Year. The participating property and The Fleeting Clouds reserve the right to identify and communicate restricted dates based on occupancy and operational requirements. All bookings remain subject to availability and prior written confirmation. The winner must select alternative dates if their preferred dates fall within a restricted period.
• The winner must comply with the property's check-in, identification, conduct, safety and house rules.
• Failure to redeem the prize within the stipulated period, including failure to provide preferred dates or complete booking formalities within a reasonable communicated timeframe, may result in forfeiture of the prize.
• If the original property becomes permanently unavailable or is unable to honour the stay, AETERNUM and The Fleeting Clouds may offer an alternative stay of reasonably comparable standard and duration, subject to the winner's agreement. No substitution will be imposed without communicating the alternative to the winner.
• The prize is subject to confirmation of the booking in writing. A tentative date discussion does not constitute a confirmed reservation.

10. Nature and Transferability of the Prize

• The prize is non-transferable, non-exchangeable and cannot be redeemed for cash, credit, store balance or any other monetary benefit.
• The winner cannot sell, assign, transfer or commercially exploit the prize.
• The two guests must travel together and comply with the property's guest registration requirements.
• Any additional guest, additional night, room upgrade or service beyond the stated prize will be at the winner's own expense and subject to the property's approval.

11. Taxes and Other Charges

Any personal expenses, incidental charges or applicable taxes arising from services outside the stated prize inclusions will be borne by the winner.

Any tax liability, withholding or reporting obligation arising specifically from the award or receipt of the prize will be dealt with in accordance with applicable Indian law. The winner will be responsible for providing any information or documentation reasonably required for statutory compliance.

12. Cancellation, Changes and Unforeseen Circumstances

• AETERNUM reserves the right to make reasonable administrative changes to the promotion where required by law, regulatory direction, technical necessity, fraud prevention or circumstances beyond its reasonable control.
• If the promotion or prize arrangement must be suspended, modified or cancelled due to legal requirements, force majeure, closure of the participating property, safety concerns or other circumstances beyond reasonable control, AETERNUM will communicate the change through its official channels.
• Where reasonably possible, AETERNUM will seek to provide a comparable alternative prize or arrangement.
• AETERNUM will not be responsible for delays or inability to fulfil the stay caused by events beyond its reasonable control, including natural disasters, extreme weather, road closures, government restrictions, public emergencies or property closure.
• Nothing in this clause permits AETERNUM to withdraw an already confirmed prize arbitrarily or to disregard applicable consumer rights.

13. Personal Information

Personal information collected for administering the promotion, verifying the winner and arranging the prize will be processed in accordance with AETERNUM's Privacy Policy and applicable data protection laws.

The winner's name or photograph will not be published or used for promotional purposes without obtaining the necessary consent, except where disclosure is required by law.

14. Limitation of Responsibility

AETERNUM's responsibility in relation to the promotion is limited to administering the promotion and coordinating the prize in accordance with these Terms & Conditions.

The stay itself is subject to the participating property's operational policies, safety requirements and booking confirmation. AETERNUM does not guarantee services or facilities beyond the specific inclusions expressly stated in the prize description.

Nothing in these Terms & Conditions excludes or limits any liability or consumer right that cannot legally be excluded or limited under applicable law.

15. General Conditions

• Participation in the promotion constitutes acceptance of these Terms & Conditions.
• These Terms & Conditions must be read together with AETERNUM's website Terms of Service, Privacy Policy and applicable purchase policies.
• In the event of any inconsistency, applicable law will prevail.
• AETERNUM's decisions on routine administration and verification will be made reasonably and in good faith, subject to applicable law and consumer rights.
• Any amendment to these Terms & Conditions will be published on the official AETERNUM website. No amendment will retrospectively remove an accrued qualifying entry or materially diminish an already confirmed prize entitlement, except where required by law or necessary to address fraud or an invalid entry.

16. Governing Law and Jurisdiction

These Terms & Conditions will be governed by the laws of India. Subject to applicable consumer protection laws and the jurisdiction of competent consumer forums, courts at New Delhi, India, will have jurisdiction over disputes arising from these Terms & Conditions.
